YOUR AGREEMENT WITH IGNITE CRUISES, LLC
IMPORTANT. PLEASE UNDERSTAND THAT YOU ARE AGREEING TO ALL OF THESE TERMS WHEN YOU BOOK ANY KIND OF TRAVEL WITH US OR WHEN YOU BOOK OR GO ON TOURS AND EXCURSIONS. THIS CONSTITUTES A LEGALLY BINDING CONTRACT.
Before we finalize arrangements for your flight, hotel, car rental, tour, cruise, or other trip, we require that you sign this form; your acceptance of this itinerary or invoice, or your clicking “I Agree” below will signify your agreement with the following terms and conditions:
IGNITE CRUISES, LLC (“IGNITE CRUISES”) acts as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in your itinerary (“Suppliers”). IGNITE CRUISES is not responsible for acts or omissions of the Suppliers or their failure to provide services or adhere to their own schedules.
IGNITE CRUISES assumes no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers; (3) any wrongful or negligent acts or omissions on the part of any other party not under IGNITE CRUISES’s control; and (4) any Supplier price drop after your travel arrangements have been confirmed, paid in full, or ticketed. You hereby release IGNITE CRUISES from all claims arising out of any problem covered in this paragraph.
Travel arrangements involving airline and cruise components are subject to supplemental price increases that may be imposed by the supplier and/or government after you have completed your purchase. You hereby consent to any such price increases and authorize your credit or debit card to be used for them. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and you may be bound by those contracts regardless of whether you receive notice of their terms. By accepting this itinerary or invoice, or by clicking “I Agree” below, you hereby consent to those terms and conditions.
Any booking changes not limited to name changes, cabin, or sailing are subject to a $25 fee per change for changes made any time after the deposit has been paid. All cancellations will be charged a $25 per person administrative fee in addition to any cruise line penalties or fees. Your reservation is subject to cancellation and/ or penalties if payments are not made as specified in your invoice. Any reservation changes or cancellation must be submitted in writing by the main guest using our online Reservation Change Request Form. Please contact us at [email protected] to request any changes and obtain the form. Please note that any changes must be allowed by the cruise line (or supplier), please refer to their Ticket Contract/Terms and Conditions.
If IGNITE CRUISES is the merchant on your credit card transaction, you agree to the following: IGNITE CRUISES’s services consist of facilitating the sale and paying the Suppliers, and once IGNITE CRUISES provides said services, you agree not to dispute the credit card charge. If a Supplier does not provide the service or ceases operations, your only recourse will be against the Supplier. If a Supplier goes bankrupt, your only recourse will be to file a claim with the Supplier’s bankruptcy court.
IGNITE CRUISES has no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. For other information concerning possible dangers at destinations, IGNITE CRUISES recommends contacting the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov. For medical information, IGNITE CRUISES recommends contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel. You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). You hereby release IGNITE CRUISES from all claims arising out of any problem covered in this paragraph. You agree that the courts in Miami Dade County will be the exclusive jurisdiction for all claims brought by you or IGNITE CRUISES, and you hereby submit to the personal jurisdiction of those courts.
For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. However, no representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. Once you are within the final payment period the cruise lines will impose strict cancellation penalties as outlined in their brochures. These penalties will not be waived even for medical reasons.
